1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Market promotions nm LLC ("Selfnex," "we," "us," or "our"), a company registered in Delaware with offices at 8 The Green, Suite A, Dover, DE 19901.

By creating an account, accessing, or using the Selfnex mobile application and website (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Description of Services

Selfnex provides an AI-driven fashion utility that allows users to create a portable "Universal Profile." Our services include:

• Color Analysis: analyzing user photos to determine "Color Seasons."
• Body Configuration: analyzing measurements and photos to determine body type.
• Styling Recommendations: curating product suggestions from third-party retailers based on your profile.
• Profile Portability: allowing you to use your Selfnex data to filter inventory on integrated retailer platforms.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Accounts and Security

To access full features, you must register an account. You agree to provide accurate, current, and complete information during the registration process.

• Security: You are responsible for safeguarding your password. You agree not to disclose your password to any third party.
• Responsibility: You are solely responsible for any activities or actions under your account, whether or not you have authorized such activities.
• Notification: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. User Content and the "Universal Profile"

You retain ownership of the data, text, photographs, measurements, and other materials ("User Content") you upload to Selfnex. However, to provide our Service, we need certain rights:

• License to Selfnex: By uploading User Content (specifically photos for color/body analysis), you grant us a non-exclusive, worldwide, royalty-free license to access, store, process, and analyze this content solely for the purpose of generating your styling profile and recommendations.
• Accuracy of Data: The quality of our recommendations depends on the accuracy of the data you provide ("Zero-Party Data"). We are not responsible for ill-fitting clothing recommendations resulting from inaccurate measurements or photos provided by you.
• Prohibited Content: You agree not to upload content that is illegal, offensive, pornographic (excluding standard body photos required for analysis, which must adhere to our submission guidelines), or that infringes on the rights of others.

6. Relationships with Third-Party Retailers

Selfnex acts as a bridge between you and fashion retailers. We are not the seller of the clothing or accessories recommended.

• Transactions: When you click a link to purchase an item, you are redirected to a third-party retailer or marketplace. Your transaction is solely between you and that retailer.
• No Liability for Products: We do not manufacture, store, or inspect the products listed. We make no warranties regarding the quality, safety, or legality of products purchased from third-party retailers.
• Returns and Shipping: All shipping, delivery, and returns are governed by the policies of the specific retailer from whom you purchased the item. Selfnex is not responsible for processing returns or refunds.

7. AI and Algorithmic Disclaimers

Our Service utilizes Artificial Intelligence to provide sizing and style advice. By using the Service, you acknowledge that:

• Color Analysis: "Color Season" determination is an algorithmic estimation and may not match the opinion of a human stylist perfectly.
• Fit Recommendations: While we strive to reduce returns through "Digital Certainty," fit prediction is an estimate based on data provided by you and the retailer. We cannot guarantee a perfect fit for every item.
• "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

8. Intellectual Property

The Selfnex Service, including its "Identity-First Commerce" methodology, algorithms, source code, visual interfaces, graphics, design, and trademarks (including the Selfnex name and logo), are the exclusive property of Market promotions nm LLC and its licensors. You agree not to copy, modify, create derivative works of, or reverse engineer any aspect of the Service.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Market promotions nm LLC, its affiliates, agents, directors, or employees be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or relating to the use of the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
